1. ORGANISER
The organisation of this event, called “The e-tron room”, is the responsibility of VOLKSWAGEN GROUP ESPAÑA DISTRIBUCIÓN, S.A. (hereinafter, VGED), with its registered address in Barcelona, Calle de la Selva, 22, Prat de Llobregat, and issued with Tax Identification Number A60198512.
2. PURPOSE OF THE EVENT
The purpose of the aforementioned event, called “The e-tron room”, is to promote e-tron technology within the context of an innovative event based on hiperreality experiences (hereinafter, the Event) and it consists of a 45-minute challenge in which you can experience the latest technological advances.
3. EVENT DURATION
The Event will be held in Madrid from the 24th of October to the 13th of November, and in Barcelona from the 27th of January to the 16th of February.
The event has a duration of 45 minutes, at most, and the extension of the aforementioned duration will remain at the personal discretion of VGED’s supervising staff.
It is recommended that all participants arrive a minimum of 15 minutes in advance of the Event start time.
In the event that participants arrive more than five minutes later than the Event start time, it shall be considered cancelled. Nevertheless, VGED reserves the right to hold the event once a reasonable period of time has passed of no greater than 15 minutes in the event that a minimum of 3 people from the team are present.
VGED will not be liable for delays in the arrival of the participants (bad weather, strikes, protests, flooding, traffic jams, civil disturbances or any other reason) due to causes beyond its control.
VGED reserves the right to cut short, postpone, amend or cancel the Event in the event of exceptional circumstances which prevent it from being held, communicating said circumstances, with as much advance notice as possible, in order to avoid any inconvenience to the participants.
4. TERMS OF PARTICIPATION
4.1 Only persons aged over 18 years will be able to participate in the Event.
4.2 The Event is designed for groups of between 3 and 4 persons. The dynamics of the Event only permit access by a maximum of 4 participants.
4.3 The Event may take place in Spanish or in English.
4.4 At the start of the Event, participants must prove their identity by means of official documents (DNI, passport, driver’s licence, etc.).
4.5 Participation in the Event entails full acceptance of all terms and conditions established herein. In the event that the participant fully or partially disagrees with the content of said Terms and Conditions, he/she must refrain from participating in the Event.
4.6 VGED will exercise its right not to admit participants in the event that they:
i) Are under the effects of alcohol or any kind of drug or other psychotropic substance.
ii) Are carrying a threatening object.
iii) Display violent behaviour.
iv) Are not wearing appropriate footwear, described in Point 4.13.
4.7 Non-compliance by any participant of the terms and conditions established herein shall lead to their automatic expulsion.
4.8 VGED will not be liable for damages (personal or to the team) caused by misuse of the installations or by not following the rules described.
4.9 The Event involves the use of fragile and sensitive elements which must be handled with care according to the instructions explained to all participants on their arrival at the establishment where the Event will take place. No type of exertion is required and there are marked zones which do not form part of the Event. In any event, participants must refrain from accessing said zones and respect the marked circuit.
4.10 VGED reserves the right to pursue all available legal avenues to which it is entitled for damages caused by the participants, particularly due to misuse of the installations.
4.11 VGED may take any necessary measures to resolve any dispute or conflict which may arise during the development of the Event.
4.12 VGED staff will always be present on the premises during the Event and shall supervise it from outside the room. It is mandatory to follow the instructions and recommendations given by staff, before accessing the Event and throughout the session.
4.13 VGED recommends that participants wear comfortable clothing and trainers to participate in the Event. For reasons of safety, the use of the following footwear is prohibited: high heels, platform shoes, sandals, hiking boots, and shoes/boots with metal toe caps.
4.14 Due to the display of certain audiovisual projections with sensitive content, the participation of people who are sensitive, squeamish, epileptic, heavily pregnant or people with cardiovascular problems is not recommended. In this regard, participants take part in the Event at their sole risk and responsibility.
4.15 Participation in said Event does not require special skills of physical exertion. It is forbidden to use personal items or items external to the Event.
4.16 It is recommended that people with reduced mobility enquire beforehand whether there are access facilities to the installations which are appropriate for their participation.
5. MECHANICS OF THE EVENT
5.1 In order to participate in the Event, the interested party will have to complete the following steps:
(i) correctly complete the Registration Form which appears on the website www.etronroom.es
(ii) accept these Terms and Conditions and comply with the terms of participation described herein.
5.2 When completing the Registration Form, participants are required to enter the following details: name and surnames, date of birth, province, post code, e-mail address and telephone number.
VGED assumes no liability for any damages of any kind which participants may incur as a result of the Event being held.
6. FORCE MAJEURE
6.1 VGED reserves the right to postpone, amend, cancel or suspend this Event or to take any reasonable corrective measures that may be necessary in the event of causes of force majeure, incidents which may arise during the course of the Event or causes beyond VGED’s control.
6.2 In the event that, due to the aforementioned causes, it is necessary to change the dates of the Event, VGED will communicate the new dates to all participants by e-mail or by any other means at its disposal with the maximum advance notice possible.
6.3 In any event, VGED shall be relieved of any obligation to compensate participants in the event that the aforementioned causes arise or, if required by law, the Event is suspended or cancelled, and participants shall be suitably informed of this situation as soon as possible.
7. IMAGE RIGHTS
7.1 All participants in the Event undertake not to divulge or disseminate any information related to its content, which shall be of a confidential nature. In this regard, VGED reserves the right to pursue all available legal avenues to which it is entitled against the participant for any damages which may be caused as a result of non-compliance or partial and/or defective compliance with the confidentiality obligation set out in this clause.
7.2 In relation to the provisions of the previous clause, given the nature of the Event it is strictly forbidden to make recordings or photograph the interior of the premises during participation in the Event. It is not permitted to use cameras, mobile devices, tablets or any other electronic apparatus, or any other object introduced from the exterior. Only the objects provided by the organisers and those located in the interior of the premises of the Event may be used. Lockers will be provided where the participants can store all of their personal items.
7.3 VGED reserves the right to expel participants immediately in the event that it identifies non-compliance with the instructions received at any time from the organisers, as well as in the event of inappropriate use of the installations.
7.4 VGED reserves the right to request participants’ authorisation to reproduce, use, exhibit, display and distribute photographs and images and/or videos taken during their participation in the Event, as well as to create derivative works of these, for their distribution in corporate media (both internal and external), on the internet and on social media, in order to publicise the aforementioned Event with a promotional nature. The aforementioned authorisation will have an indefinite duration and be global in scope, without the right to receive any consideration whatsoever in exchange.
8. DATA PROTECTION
8.1 In accordance with Organic Law 15/1999 of 13 December on the Protection of Personal Data (hereinafter, “LOPD”) and Royal Decree 1720/2007 of 21 December, approving the implementing regulations of the LOPD, the personal data provided by participants in the Event shall form part of a file owned by VGED for the purposes resulting from this document, to manage their participation in the Event and to verify that the terms for being a participant are met, as well as to inform them periodically of the news, products and services of VGED, both in writing and electronically, and such information may be adjusted to their individual profiles.
8.2 On the other hand, the data of the participants in the Event may be communicated to the rest of the companies of the Group, from the European Union, belonging to the automotive, financial and insurance sectors, an up-to-date list of which can be found on the official website www.volkswagengroupdistribucion.es, for the same purposes mentioned previously.
8.3 In the event that the participants in the Event provide the personal data of third parties, they warrant that they have informed them of the content of this clause and have obtained, in advance of their inclusion, their informed consent for the processing of their personal data by VGED.
8.4 The participants in the Event may exercise their rights to access, rectify, cancel and oppose the processing of their personal data, as well as to revoke their consent for the sending of electronic marketing communications by sending an e-mail to [email protected], clearly stating their name, surnames, and the request which they wish to exercise, and including a copy of their National Identify Document (DNI) or similar document accrediting their identity.
9. DISPUTE RESOLUTION AND APPLICABLE LEGISLATION
VGED and the participants in the Event, by mutual agreement and with express waiver of their own jurisdiction, agree that any litigious situation resulting from these Terms and Conditions shall be resolved by the Courts of the city of Barcelona in accordance with Spanish common laws.
